The short version
These are the rules for using phototoss.com and joining the PhotoToss waitlist. PhotoToss is a one-person business. In these terms, "we," "us," and "our" mean that business.
These terms do not govern the PhotoToss iPhone app. Use of the app is governed by the applicable App Store terms and end-user licence, together with any additional terms presented in the app. For questions about the app, start with its privacy page or email support@phototoss.app.
If anything here is unclear, email us and we will take a look.
Who we are
PhotoToss is me — Gérard. On official paperwork my name is written Boanoro, Adrien-Gerard, and that is the name of the one-person business behind the site.
PhotoToss and phototoss.com are operated by:
Boanoro, Adrien-GerardAvenue Roger Vandendriessche 2, boîte b0081150 Woluwe-Saint-PierreBelgiumThe business is registered with the Belgian Crossroads Bank for Enterprises.Enterprise no. 0507.820.734VAT no. BE 0507.820.734support@phototoss.appWhat these terms cover
These terms cover phototoss.com, its subdomains, and the PhotoToss waitlist. They do not govern the PhotoToss iPhone app itself.
If the app opens a page hosted on phototoss.com, these terms govern your use of that page; the app's own terms govern your use of the app.
The waitlist
The waitlist entry contains two things: the email address you submit and the campaign tag carried by the link you followed.
Our hosting and email providers may also create routine technical and email-delivery logs. The PhotoToss privacy page explains what is processed, why it is processed, how long it is kept, and what rights you have.
Joining the waitlist means saying yes to three emails:
- a confirmation email;
- one launch email; and
- at most one useful PhotoToss update in between.
That is the whole product-email plan. If the law requires a separate notice, or we materially change these waitlist rules, we may send that administrative message too.
You can leave whenever you like. Use the unsubscribe link in an email, reply to one of the emails, or write to support@phototoss.app. We will stop the waitlist emails and handle the associated information as described on the privacy page.
Joining is free. It does not guarantee a launch date, early access, or availability of the app.
Using the site
Most people will never need this section. Browse the site, share its links, and join the waitlist normally and we are fine. The line is deliberate interference with the site or with information that belongs to someone else.
Please do not:
- send automated traffic that slows the site down or gets in other people's way;
- bypass the site's protections, try to break the waitlist form, or access information that is not yours;
- carry out deliberate security testing without asking us first; or
- scrape the waitlist, resell the site's content, or copy the site and pass it off as your own.
If you come across a security problem without going looking for one, email support@phototoss.app before publishing the details. If you want to test deliberately, ask first. A good-faith report that respects other people's information and does not damage the service is welcome.
Copyright and press use
Unless a page says otherwise, the original copy, code, and design on phototoss.com are owned by or licensed to us.
Quote it, screenshot it, or link to it. Reviews, press coverage, public discussion, and teaching do not need our permission; just identify PhotoToss as the source.
What you may not do is copy the whole site or most of it, sell its words, code, or design as a template or product, or claim any of it as your own work.
Third-party material, including the reviewer quotations on the landing page, still belongs to its respective rightsholders. Our attribution and source link do not give us permission to license that material to you. Follow the source and check with the rightsholder unless the law already allows your use.
Disclaimers
The site can contain mistakes, and sometimes it may be unavailable. If you spot a factual error, email support@phototoss.app and we will look at it.
Nothing here takes away a right the law gives you, or excludes or limits liability where the law does not allow that.
Governing law and disputes
These terms are governed by Belgian law.
If you are a consumer, this choice does not deprive you of any mandatory protection provided by the law that would otherwise apply to you, including the mandatory consumer-protection rules of the country where you habitually live where applicable.
Please contact support@phototoss.app first so that we can try to resolve a problem directly.
If you are a consumer and have already tried to resolve the dispute with us, you may ask the Belgian Consumer Mediation Service to assess whether the complaint falls within its remit.
For a cross-border consumer dispute within the EU, Norway, or Iceland, your local member of the European Consumer Centres Network may also provide free advice and assistance.
Nothing in this section limits any right you may have to bring a claim before a competent court.
Changes to these terms
When these terms change, the revised version will appear here with a new date. A change applies from that date; it does not rewrite the past or remove rights and obligations that have already arisen.
There is no "we may change these whenever we like without telling you" clause. If a change materially affects people who are currently on the waitlist, we will email them before it takes effect. Anyone who does not want to remain on the waitlist can unsubscribe.
